Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of the OxyHyperbaric website and your purchase and attendance of mild hyperbaric oxygen wellness sessions at our clinic in Shenandoah, Texas. OxyHyperbaric is a trade name of REGENOXY LLC, a Texas limited liability company. By booking, attending, or using our services, you agree to these Terms.
1. Wellness Services Only
OxyHyperbaric provides mild hyperbaric oxygen therapy (MHBOT) for general wellness and relaxation only. Our services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The FDA has cleared hyperbaric chambers for specific medical uses under physician supervision; wellness applications at our facility are off-label and not FDA-evaluated for the benefits described on our website.
You are responsible for consulting your own physician regarding whether wellness sessions are appropriate for you. Medical Director: Dr. James Hill.
2. Eligibility & Client Responsibilities
- You agree to provide accurate contact and health-related information requested for safe operation of sessions.
- You must disclose relevant medical conditions, medications, implants, pregnancy, recent surgery, or other factors that may affect session safety.
- You agree to follow all staff instructions, facility rules, and pre-session guidelines.
- Minors must be accompanied by a parent or legal guardian who consents to services on their behalf.
We may refuse or discontinue services if we reasonably believe participation poses a safety risk or violates these Terms.
3. Booking & Appointments
Booking is required to attend sessions. Appointments may be made online at our booking page or by calling (713) 591-3379. A confirmed appointment reserves a specific time slot and chamber availability.
Please arrive on time. Late arrivals may result in a shortened session or cancellation of the appointment at our discretion, without refund or credit.
4. Cancellation & No-Show Policy
24-hour cancellation policy: You must cancel or reschedule your appointment at least 24 hours before your scheduled session time. Any appointment that is not cancelled at least 24 hours in advance, or any no-show, will be forfeited. Forfeited sessions are not refundable and will not be reinstated or credited to your account, including for prepaid packages.
To cancel or reschedule, use the booking platform where you made your appointment or contact us directly. We recommend canceling as early as possible to avoid forfeiture.
5. Payments, Pricing & Packages
- Session and package prices are listed on our website and may change; the price at the time of purchase applies to that transaction.
- All prices are subject to 8.25% Texas sales tax at checkout unless otherwise stated.
- Payment is due at the time of booking or as stated for your package. We accept payment methods shown at checkout.
- Prepaid sessions and packages are for wellness services at OxyHyperbaric and are not transferable without our written approval.
- Refunds are not provided for forfeited sessions (see Section 4) or for services already rendered.
6. Facility Rules & Conduct
Clients must treat staff and other clients with respect. Prohibited conduct includes harassment, disruptive behavior, use of prohibited substances, smoking on premises, and unauthorized photography in treatment areas. We may remove clients who violate these rules without refund.
7. Limitation of Liability
To the fullest extent permitted by Texas law, OxyHyperbaric and its owners, employees, contractors, and medical director shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or wellness services. Our total liability for any claim related to services shall not exceed the amount you paid for the specific session or package giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify and hold harmless OxyHyperbaric and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of our services, or violation of applicable law.
9. Website Use
Content on oxyhyperbaric.com (text, images, logos, and design) is owned by or licensed to OxyHyperbaric and may not be copied, reproduced, or distributed without permission. You may use the site for lawful personal purposes only.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.
11. SMS Text Messaging Program
Program name: OxyHyperbaric Appointment Notifications (REGENOXY LLC)
Program description: REGENOXY LLC d/b/a OxyHyperbaric sends optional, transactional text messages related to your wellness appointments at our Shenandoah, Texas clinic. Messages may include appointment confirmations, reminders, rescheduling notices, and cancellation notices. We do not send marketing or promotional SMS through this program.
How you opt in
- Complete the online booking form at https://oxy-agenda.vercel.app/booking/us (service, date, time, name, phone, and email).
- Optionally check the unchecked consent box to receive appointment-related SMS from REGENOXY LLC. The box is not pre-selected.
- Tap Confirm appointment. Your consent is recorded with your booking.
You may book without SMS by leaving the consent box unchecked.
Message frequency & costs
Typically 1–3 messages per appointment (for example, confirmation and reminder). Frequency varies if you reschedule or cancel. Message and data rates may apply. Check with your wireless carrier.
Opt out & help
- Reply STOP to any message to unsubscribe from SMS.
- Reply HELP for assistance.
- Contact clinic staff or email hello@oxyhyperbaric.com to update preferences.
Privacy
Mobile phone numbers collected for SMS are used only to deliver appointment-related messages described in this section. We do not sell or share mobile numbers with third parties for their marketing purposes. See our Privacy Policy for full details.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms or our services shall be brought in the state or federal courts located in Montgomery County, Texas, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms at any time by posting a revised version on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.
